Agreement to Terms

By accessing or using the services provided by J McRoberts Construction LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services Provided

J McRoberts Construction LLC provides web hosting, website development, and related digital services. Our services include but are not limited to:

  • Custom website design and development
  • Web hosting and server management
  • Website maintenance and updates
  • Marketing and social media services
  • Technical support

Service Agreements

Specific terms for individual projects will be outlined in a separate service agreement or proposal. These Terms of Service apply generally to all interactions with our business and website.

Payment Terms

  • Setup fees are due upon project initiation unless otherwise agreed
  • Monthly hosting fees are billed in advance
  • Late payments may result in service suspension after 30 days
  • All fees are non-refundable unless otherwise specified in writing

Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information for your project
  • Provide timely feedback and approvals during the development process
  • Ensure you have rights to any content (text, images, logos) you provide
  • Maintain the confidentiality of any login credentials we provide
  • Use our services in compliance with all applicable laws

Intellectual Property

Your Content

You retain ownership of any content, materials, or intellectual property you provide to us. By providing content, you grant us a license to use it for the purpose of delivering our services.

Our Work

Upon full payment, you own the custom website design and content created specifically for your project. We retain the right to use the work in our portfolio unless otherwise agreed.

Third-Party Components

Websites may include third-party components (fonts, libraries, plugins) that are subject to their own licenses. These remain the property of their respective owners.

Hosting Terms

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be communicated in advance when possible
  • We perform regular backups but recommend clients maintain their own backups
  • We reserve the right to suspend hosting for sites that violate our acceptable use policy

Acceptable Use

You may not use our services for:

  • Illegal activities or content
  • Distributing malware or spam
  • Infringing on intellectual property rights
  • Hosting content that is defamatory, obscene, or harmful
  • Any activity that could damage our servers or network

Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount paid for services in the preceding 12 months
  • We are not responsible for losses due to factors beyond our control (acts of God, internet outages, third-party failures)

Warranty Disclaimer

Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee that our services will meet all your requirements or that they will be error-free.

Termination

  • Either party may terminate services with 30 days written notice
  • We may terminate immediately for violation of these terms
  • Upon termination, we will provide reasonable assistance in transferring your website and data
  • Prepaid fees for unused services may be refunded at our discretion

Dispute Resolution

Any disputes arising from these terms or our services will be resolved through good-faith negotiation. If negotiation fails, disputes will be subject to the laws of the State of Missouri, with venue in Perry County, Missouri.

Changes to Terms

We may update these Terms of Service from time to time. Continued use of our services after changes constitutes acceptance of the new terms. Material changes will be communicated to active clients.
